Welcome to SecVibe. These Terms and Conditions ("Terms") govern your access to and use of the SecVibe VS Code extension and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing, accessing, or using SecVibe, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Description of Service

SecVibe is a VS Code extension that provides security analysis and controls for applications developed using AI assistance. The Service analyzes code patterns, identifies potential security issues, and provides insights to help improve the security posture of AI-generated code.

3. User Responsibilities

IMPORTANT: Protection of Sensitive Information

At this stage, SecVibe does NOT filter or redact personally identifiable information (PII), secrets, credentials, API keys, passwords, or other sensitive data from code or prompts submitted through the Service.

You are solely responsible for:

  • Ensuring that you do NOT include any PII, secrets, credentials, API keys, passwords, tokens, or other sensitive information in your code, prompts, or any other content submitted to or analyzed by SecVibe
  • Reviewing and sanitizing your code before using the Service
  • Compliance with all applicable data protection and privacy laws
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Using the Service in accordance with these Terms and all applicable laws and regulations

4. Data Collection and Use

Data Storage and Product Improvement

By using SecVibe, you acknowledge and agree that we collect, store, and use data submitted through the Service, including but not limited to code samples, prompts, analysis results, and usage patterns, for the following purposes:

  • Product Improvement: To enhance, develop, and improve the Service, including training and refining our security analysis models and algorithms
  • Service Operations: To provide, maintain, and improve the functionality of the Service
  • Analytics: To understand usage patterns and optimize the user experience
  • Research and Development: To develop new features, tools, and security capabilities

We retain the right to use anonymized and aggregated data derived from your use of the Service for any lawful purpose, including research, analytics, and product development.

5. Intellectual Property

5.1 SecVibe Property

SecVibe and its original content, features, and functionality are owned by SecVibe and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 User Content

You retain ownership of any code or content you submit to the Service. However, by submitting content to SecVibe, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and distribute such content for the purposes described in Section 4.

6. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any malicious code, viruses, or harmful data
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
  • To reverse engineer, decompile, or disassemble the Service
  • For any commercial purpose without our express written consent
  • To submit content that contains PII, secrets, or sensitive information (as detailed in Section 3)

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

SecVibe does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the use of the Service will be accurate or reliable
  • Any security issues or vulnerabilities will be detected or prevented
  • The Service will meet your specific requirements

You acknowledge that SecVibe is a tool to assist with security analysis and does not guarantee the security of your applications. You remain solely responsible for ensuring the security of your code and applications.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SECVIBE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of your data
  • Any security breaches or vulnerabilities in your applications
  • Any errors or omissions in the Service's analysis or recommendations
  • The exposure of PII, secrets, or sensitive information you submitted to the Service

9. Indemnification

You agree to indemnify, defend, and hold harmless SecVibe and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your submission of PII, secrets, or sensitive information to the Service

10. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, third parties, or our business interests
  • Exposes us to legal liability

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

12. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SecVibe operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the jurisdiction in which SecVibe operates.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and SecVibe regarding the Service and supersede all prior agreements and understandings.

FINAL REMINDER

By using SecVibe, you acknowledge that you understand and accept full responsibility for not submitting any PII, secrets, credentials, or sensitive information through the Service. SecVibe is not liable for any exposure or misuse of such information if you fail to comply with this requirement.
